International Withholding Tax

Overview

This course provides a grounding in the international withholding tax landscape. In it, we explore the context of double tax treaties, reclaim methodologies, benchmarking of tax processing, specific market issues, and how technology is affecting the tax landscape.

There is also brief discussion of the impact of US withholding tax regulations as a precursor to the new global withholding tax transparency model (AEoI and CRS).

This course can be tailored to your individual experience levels and is offered as a beginner, intermediate or advanced course.

Agenda

Our beginner course explores and explains the context of double tax treaties, types of refund mechanism and common solutions.

Our intermediate course covers double tax treaties, EC Directives and ECJ claims, reclaim methodologies, different instrument types, client types – opaque transparent – and how these affect claims processing. The course also introduces benchmarking of tax processing.

Finally, our advanced course covers double tax treaties, EC Directives and ECJ claims, reclaim methodologies, different instrument types, client types and how these affect claims processing. The course also covers specific market issues, such as Italian PRT, Russian claims, ADR claims. It includes detailed discussion and exercises of benchmarking tax processing, workshop sessions on Statute of Limitations, Process Efficiency and examples of the effects of different approaches to tax processing. Discussion of market infrastructures, such as T2S and the CSD landscape, are integrated into this course to show how technology is affecting the tax landscape. There is also brief discussion of the impact of US withholding tax regulations as a precursor to the new global withholding tax transparency model (AEoI and CRS).

Format

This course is offered on an in-house basis. Clients will be asked to provide some advance preparatory information which will then be used to customise the course materials so that the material is of more relevance to their situation.

This course can be delivered to a group of between 10 and 40 delegates over a period of either one or two days.

Two day courses cover the same content in more depth, with some additional material, exercises and workshops to help delegates absorb the content more effectively. There is also a greater amount of time allowed for questions, so delegates have the time to structure and ask questions that are relevant to their circumstances.
